1. TERMS OF SALE ACCEPTANCE
1.1 - The contract between Restart Srl and the Customer shall be concluded with the acceptance of the order, even partial, by Restart Srl. This acceptance is automatic, unless otherwise communicated to the client. By placing an order in the manner provided, the Customer declares having read all the information provided during the purchase process, and accepts the general conditions and payment method transcribed below.
1.2 - If the customer is a final consumer (i.e. a person who buys goods for purposes not related to his/her profession), after the online purchase procedure, he will print or save an electronic copy but also keep these general sales conditions, subjected to the requirements of Art. 50 and the ss of the Legislative Decree no. 206/05.
1.3 - It excludes any right of the Customer for damages or compensation, and any contract or tort liability for any direct or indirect personal and/or property, caused by the rejection, even partial, of an order.
2. HOW TO BUY
2.1 - The customer can only purchase products from the electronic catalogue on the websites www.dreamleatherbags.com and www.italianleatherbrands.com, as described in the related information sheets. It is understood that the picture accompanying the description of a product may not be fully representative of its features but it may differ from the picture in color, size, and accessories. All purchase support information (Glossary, Buying Guide, etc ...) is intended as mere general information, not dued to specific characteristics of a single product. Sale prices are VAT and all other taxes included only for final customers, but are exclusive of VAT, when specified, for companies and VAT provided customers.
2.2 - The correct order is confirmed by Restart Srl via an e-mail, sent to the email address supplied by the customer. This confirmation message will contain date and time of the finalisation of the order and an Order Number to be used in any further communication with Restart Srl. The message will include all data entered by the customer who agrees to verify its correctness and communicate any corrections to the customer service.
2.3 - In case of non-acceptance, Restart Srl guarantees a communication to the customer via e-mail or telephone within three working days from the reception of the e-mail summary.
Restart Srl accepts orders for products within the limits of the quantity in store and therefore the acceptance of the offer is subjected to availability in stock of the products. Restart Srl is committed to promptly notify the customer of any unforeseen lacks in stocks dued to an excess of demand or other causes.
3. PAYMENT METHOD
3.1 - Credit card: in case of purchases with credit card payments, the amount dued is charged on the credit card simultaneously with the order.
3.2 - Restart Srl reserves the right to require to the Customer information (eg. Landline phone number) or copies of identification documents proving the ownership of the credit card used for the purchase. In absence of the required documentation, Restart Srl reserves the right to refuse the order.
3.3 - During the finalisation of the purchase Restart Srl is never able to know information about the buyer's credit card, sent via secure connection directly to the bank handling the transaction. Restart Srl may retain such information only upon request and consent of the customer. In this case Restart Srl guarantees that such data are stored according to certificated safety standards and that they are always displayed in masked mode.
3.4 - Cash on Delivery: in the case of purchase with cash on delivery payment, a further fee will be applied to the total amount dued, clearly specified when this payment method is chosen. The payment has to be made directly to the carrier, when it will deliver the products. The payment must be done in cash, checks are not accepted.
3.6 - Purchases via PayPal: in cases of purchase of goods with PayPal payment, together with the finalisation of the online transaction, PayPal will immediately charge the amount dued for your purchase.
4. DELIVERY TERMS AND CHARGES
4.1 - Restart Srl can accept orders for deliveries to all countries in the world. Restart Srl delivers the products by courier and / or carriers within 30 days from the acceptance of the order.
4.2 - For every order placed on the websites or www.dreamleatherbags.com www.italianleatherbrands.com, Restart Srl sends an electronic format document (receipt) of the product sent. In case of invoice, Restart Srl will use the information provided by the Customer. After the execution of the order it will not be possible to request an invoice if not previously expressed. After the issuance of the invoice it will not be possible to apply variations.
4.3 - Delivery costs, if to be charged, are charged to the customer and are clearly specified during the order process. No further payment is dued by the customer.
4.4 - No responsibility can be attributed to Restart Srl in case of delay of the preparation of the order nor delay in the delivering of the order, can in no way represent reason for raising requests for partial or full refund of the amount paid.
4.5 - The delivery of the ordered happens at ground floor except:
in case of different communication from our customer service,
in case it is specified in the Product Data Sheet,
the order requests delivery to the floor, if applicable.
At the moment of the delivery of the goods by the courier, the customer is required to check:
that the number of boxes is the same as indicated in the invoice
the packaging is not damaged or wet or otherwise altered, including the sealing materials (adhesive tape).
Any damage to packing and / or product or the mismatch in the number of packages or particulars, must be immediately notified, and packages can be accetped by WRITING on the proof of delivery courier document that the package is accepted "under reserve" and specifing why UNDER RESERVE (eg. "Packaging broken", "packaging crushed" , etc.). Once signed the slip, the customer can not make any objection about the appearance of the goods.
Any problems concerning the physical, correspondence or completeness of the products received must be reported within 3 days from delivery, as specified in the present document.
4.6 - If the customer fails to collect the package within 5 working days it will be stocked at courier's warehouse because of repeated inability to deliver to the address specified by the customer. After 5 working days the order will be sent back to Restart Srl warehouses and the customer will be charged of additional shipping costs.
5. RESTART SRL WARRANTIES
All products sold by Restart Srl are covered by manufacturer's standard warranty and the 24-month warranty for defects, according to D.Lgs. 206/05. To use the warranty, the customer needs to keep the invoice or the equivalent accompanying document.
5.1 - The warrany of 24 months under the Legislative Decree 206/05 applies to the products presenting a lack of conformity, provided that the product has been used correctly, respecting its recommended use as provided in the technical documentation. This warranty is for private consumption (a person who buys goods for purposes not related to his professional activity, or making a purchase order form without indicating a reference to VAT). In case of lack of conformity, Restart Srl provides, without cost to the customer, the restoration of conformity by repairing or replacing the damaged item with a product of equal or superior characteristics.
5.2 - If Restart Srl for whatever reason, is unable to give to the customer a product warranty (repaired or replaced), the customer may require an appropriate reduction of the price or the termination of the contract resulting in the return of the amount paid. In determining the reduction of the price or the amount to be refunded will take into account the appropriate use of the item.
5.3 - The time to repair or replace the product depends solely on the policies of the manufacturer and no damage can be required to Restart Srl for any delays in repairings or replacements.
5.4 - In cases where the application of the warranty entails the return of the product, the product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc. ..); To limit damage to the original package, we recommend to insert the item into a second box. In all cases the attachment of labels or tape directly on the original product packaging should be avoided. The customer will be given an authorization number to return the product (RMA) to be sticked outside the package, following the instructions provided directly in the relevant e-mail for authorization.
6. CUSTOMER WARRANTIES
The Customer represents and guarantees that (i) is of age indicated in the art. 3 of the Consumer Code; (ii) that the data supplied by the customer for the execution of the contract is correct, truthful and do not violate any third party's rights.
7.1 - The personal information requested for the order are collected and processed to meet the expressed requests of the customer. Restart Srl guarantees its customers the full respect of the related rules on the processing of personal data covered by the privacy law according to the Legislative Decree no. N. 196 of 30.06.03. 7.2 - Applicable Law: The sales contract between the customer and the Restart Srl is executed in Italy and it is regulated by the Italian law. For the solution of civil and criminal litigation arising from the conclusion of this contract of sales, if the customer is a final consumer, the local jurisdiction of his country of residence is the reference; in all other cases, the only local jurisdiction is the Foro di Pisa.
8. RIGHT OF WITHDRAWAL
The Restart Srl's warranty of 14 DAYS MONEY BACK, assures you the chance to return one or more products of the same order and to be refunded the amount paid for the product thanks to the 14-days right of withdrawal.
Withdraw Right - legislative reference (D.Lgs 206/2005)
The right of withdrawal is the ability for the consumer to return the purchased product and the refund of the product cost. Restart Srl, in order to comply with new European regulations, guarantees the client this right within 14 days from the product delivery date.
Restart Srl reserves the right to withhold the supported costs for the dispatching of the order according to the table here below:
Order shipped to Italy: € 9,00
Order shipped to Europe (Switzerland and Norway excluded): € 19,00
Order shipped to Europe, Extra EU, USA and Canada: € 32,00
Order shipped to rest of the world: € 45,00
Costs are to be intended 22% VAT excluded where applicable for each returned package. They will be subtracted from the amount to be refunded.
In case of duties, customs clearance will be fully charged on the client.
The right of withdrawal is lost if the returned product is not intact, that is found:
not having the original packaging;
absence of product components (accessories, straps, pockets, zippers, etc.);
damages to the product for reasons other than transportation;
- product usage evidence;
- product damaged because of unappropriate use.
In these cases Restart Srl will not authorize the return nor any refund to the customer.
Furthermore, the right of withdrawal is not applicable and not expected in case of customized or personalized products.
Customer's refusal of collecting the items purchased from the courier is going to be intended as a will of excercising the 14 days return right and the items will be returned to Restart S.r.l. by the courier. In this case, the shipping, the depisit and the return procedure management costs will be charged to the customer.
In case the customer wishes to withdraw his/her purchase after the procedure, he/she needs to comply with the following instructions:
within 14 days from the reception of the product the customer must send an email at email@example.com stating his/her intention to invoke the right of withdrawal.
Once verified the valid return timing and the request, Restart Srl will authorize via email the return request. It will be possible to ship back the product by using any courier the customer preferes. The product must return to Restart Srl within 14 days from the return authorization. A Restart Srl operator will test the item once received; in case the customer requested a full refund of the amount paied, Restart Srl will refund the product after having verified the integrity of the returned product; if the customer has instead accepted our coupon (voucher purchase) he/she can buy another product on our website at any time.
